REGULATIONS FOR THE USE OF THE “POMORSKIE!” GRAPHIC MARK

 

§ 1
These Regulations define the terms and conditions for the use of the “POMORSKIE!” graphic mark, hereinafter referred to as the Mark. The terms used in these Terms and Conditions shall have the following meanings:
Voivodeship – this shall be understood as the Pomeranian Voivodeship
User – this shall be understood as the entity authorized to use the Mark
Form – an application form for the use of the Mark containing an undertaking to comply with the provisions of these Terms and Conditions, available at the following internet address: pomorskie.eu/en/rules-for-using-the-coat-of-arms.

§ 2
The Voivodeship declares that it holds the copyrights to the Mark, allowing for the use of the Mark in all fields of exploitation under Agreement No. 82/U/254/DTP/2014 of August 8, 2014, concluded with Andrzej Pągowski, conducting business under the name Kreacja Pro Andrzej Pągowski, enabling the disposal of the Mark within the meaning of the Act of February 4, 1994 on Copyright and Related Rights.
The “Pomorskie!” Mark It is one of the promotional tools for the Pomeranian Voivodeship. The right to use the Logo is granted free of charge, for non-commercial purposes, to entities using the Logo in accordance with the strategic goals of the Voivodeship, which:
promote the Pomeranian Voivodeship and build its positive image,
facilitate the integration of local and regional communities, and stimulate the activity and economic development of the Voivodeship.

§ 3
The Mark may only be used in a manner that:

  • is in accordance with these Regulations,
  • is in accordance with the law, public order, good customs, and principles of social coexistence,
  • is not misleading as to the nature, purpose, origin, quality, and characteristics of the goods and services marked with the Mark,
  • is not infringing the personal and/or property rights of third parties,
  • is not detrimental to the good name and image of the Pomeranian Voivodeship,
  • is not leading to the depreciation of the mark or a reduction in the prestige of the Pomeranian Voivodeship.

 

The Mark may only be used under the following conditions:

  • The Mark may be proportionally enlarged or reduced.
    The following is not permitted:
  • Changing the shape, proportions, color, or elements of the Mark;
  • Removing, adding, or altering elements of the Mark;
  • Animating, distorting, or otherwise modifying the appearance of the Mark.
  • The Mark should be placed in a form equivalent to other marks.
  • A sample of the Mark is available on the website pomorskie.eu/en/rules-for-using-the-coat-of-arms.

 

§ 4
The Voivodeship reserves the right to verify the proper use of the Mark, as well as Users’ compliance with the conditions set forth in these Regulations.
The Voivodeship reserves the right to file claims in the event of any violations by the User of these Regulations or applicable law in connection with the use of the Mark.

§ 5
To obtain the right to use the Mark, it is necessary to correctly complete the Form and accept its content (hereinafter referred to as “Form Acceptance”). Until the Form is Accepted, the User may correct the entries entered in the Form.
Acceptance of the Form may only be validly made by persons authorized to represent the entity.
Acceptance of the Form constitutes consent to the provisions of these Regulations.
The Voivodeship maintains a register of entities authorized to use the Mark.
The right to use the Mark may be lost in the event of a violation of the provisions of these Regulations, as well as in the event of using the Mark for purposes other than those indicated in § 2, paragraph. 3 above, or using the Mark contrary to the rules provided on the website pomorskie.eu/en/rules-for-using-the-coat-of-arms..

§ 6
In matters not regulated by these Terms and Conditions, the provisions of the Civil Code and the Act of February 4, 1994, on Copyright and Related Rights shall apply.

Any disputes that may arise in connection with the use of the Mark shall be submitted to the court having jurisdiction over the seat of the Voivodeship.
